Tuesday night the House did not convict anyone. It did not hold a trial. It took a motion to table — Washington-speak for throw this in the trash — and 147 members voted no. Keep it alive. That is the number that matters. Not because Al Green of Texas suddenly discovered a high crime in August. Because 147 is the size of the caucus that will not wait for a committee, a witness list, or a majority. They already have a theory: enforcing the immigration laws is impeachable. The rest is paperwork.

The resolution was H.Res. 1486. Introduced August 24. One article. Abuse of power. ICE and Border Patrol operating, in Green’s telling, in contempt of the First, Fourth, and Fifth Amendments, plus court orders. He named four people killed in encounters with federal officers this year and called that a presidency. The House did what a Republican House does with a privilege resolution from a member on his way out the door. It tabled it, 232 to 147, with about 47 voting present.

Who Brought It

Green is the sponsor because Green is always the sponsor. This is his eighth run at the same man, the fourth since January 2025. He lost his primary in May. He leaves in January. A man with no next election is the perfect instrument. He does not need the leadership whip. He does not need an investigation. He needs a privileged motion and a camera. “The Constitution doesn’t have a wait clause,” he said before the vote. Correct. It also does not have an “I lost my district so I’ll impeach the president over deportations” clause. He used the one he had.

Leadership did not whip yes. The three names at the top of the minority — the leader, the whip, the caucus chair — voted present and put out the priestly statement. Impeachment is sacred. It requires documents, witnesses, hearings, a national consensus. None of that work has been done, they said, because the majority only rubber-stamps. Then the tell: when we have the gavel, every tool, day one. Present is not a principle. Present is a bookmark.

Eighteen Democrats voted with nearly every Republican to kill it. The rest of the minority split between present and the 147. Compare that with June of last year, when 128 Democrats helped table a similar Green resolution. The floor has moved. Fewer of them will be the adult in the room next time. More of them will be the vote.

What the Article Actually Says

It does not allege a bribe. It does not allege a coup. It alleges that the agencies that remove illegal aliens and police the border have been allowed to work, and that some encounters ended in death. That is a policy fight dressed in constitutional vestments. Every administration that has run an interior force has had ugly shootings. Treating those as high crimes and misdemeanors means the next Democratic House does not need a scandal. It needs a raid that looks bad on a phone.

If they take the majority in November, they will not need Green. They will have committees, subpoenas, and a majority of the 147 plus whoever was “present” until it was safe. The sacred-process paragraph evaporates on January 3. They wrote the ending in the same statement they used to dodge the vote.

The Warning Is the Math

A House impeachment is a simple majority. Conviction still dies in a Senate the other party may hold. That has never stopped them. The point of the exercise is not removal. It is the year of hearings, the freeze of the executive, the donor tape, the headline that says the president is a criminal for doing the job the voters hired. They did it twice in the first term. They have been practicing the third in miniature every time Green drops a resolution and 147 refuse to throw it away.

Eighteen Democrats still think this is a bad midterm look. They will be the ones primaried from the left for “protecting” him. The 147 will be the ones who say they were consistent. Both factions end in the same place if the gavel changes hands: articles on the floor, because the base was promised a scalp and ICE is the scalp they can reach.

Green will not be there to vote. The resolution will. Different letterhead, same theory. Immigration enforcement as an impeachable offense. That is not a warning from a cable panel. That is 147 recorded votes and a leadership memo that already scheduled day one. They could not impeach him Tuesday. They counted the hands for the day they can.
