This case involves Paula Paulette Harlow, a 75-year-old woman from Kingston, Massachusetts, who was sentenced to 24 months in prison by Judge Colleen Kollar-Kotelly, 81.

Harlow was convicted under the Freedom of Access to Clinic Entrances (FACE) Act* and of a civil rights conspiracy for participating in a pro-life blockade of a Washington, D.C., abortion clinic in 2020.

Harlow’s sentencing was met with shock and controversy, especially after her husband pleaded for mercy, expressing his fear that his wife, who is in poor health, would die alone in prison. Judge Kollar-Kotelly reportedly responded by saying that she hopes Harlow will “make an effort to remain alive” because that is a “tenet of her religion.” This comment has been widely criticized as insensitive and inappropriate.

The case has sparked outrage among some who believe that Harlow’s sentence is too harsh and that the judge’s comments were inappropriate. It has also raised questions about the application of the FACE Act and the boundaries of free speech and peaceful protest.

*The Freedom of Access to Clinic Entrances Act, also known as the FACE Act, is a United States law that was signed by President Bill Clinton in May 1994. The Act prohibits the following three things:

  1. The use of physical force, threat of physical force, or physical obstruction to intentionally injure, intimidate, interfere with or attempt to injure, intimidate or interfere with any person who is obtaining an abortion.
  2. The use of physical force, threat of physical force, or physical obstruction to intentionally injure, intimidate, interfere with or attempt to injure, intimidate or interfere with any person exercising or trying to exercise their First Amendment right of religious freedom at a place of religious worship.
  3. The intentional damage or destruction of a reproductive health care facility or a place of worship.
