FOR IMMEDIATE RELEASE
July 21, 2026
Washington, D.C.– Just before midnight last night, the United States Court of Appeals for the District of Columbia Circuit ruled 2-1 in favor of the Oversight Project and against Joe Biden. The D.C. Circuit rejected Biden’s privacy arguments and cleared the way for the release of the tapes of his 2017 interview with his ghost writer. The court delayed release of the tapes until August 3 to give former President Biden the chance to appeal to the Chief Justice.
Last night’s ruling is the latest in a string of victories for the Oversight Project against the Autopen President. Last year, we secured the release of the audio of President Biden’s interview with Special Counsel Robert Hur. These revelations show how President Biden’s mental decline gave rise to the autopen presidency.
Vice President of Litigation, Jeff Clark:
“The DC Circuit’s rejection of Biden’s desperate attempt to silence his ghostwriter tapes marks a decisive win for government transparency and accountability. After months of briefing and snazzy puff pieces about Biden’s fancy legal team in glossy photos, the former President’s counsel finally hit a wall—two judges saw through the charade and denied his attempt to bury evidence of his cognitive decline. Those audio recordings with biographer Mike Zwonitzer weren’t meant to stay hidden forever. What’s striking is how desperately Biden fought to keep these conversations sealed, knowing full well they’d reveal more about his capacity than the defenders of the Autopen Presidency wanted to admit. The claim that the tapes were private family diaries or heirlooms is risible. Biden made $8 million from the book advance. He eventually used the book to springboard to a new chapter in his political career—one that even his lesser 2017 level of senility should have prevented from ever getting off the ground.
Our persistence paid off, proving that FOIA requests still matter when conservative watchdogs refuse to let powerful politicians bury inconvenient truths. This isn’t just about memoirs; it’s about whether Americans deserve to know who’s really running things. Every hour Biden spends litigating against disclosure is another hour admitting his party’s establishment put him in a protective cocoon of lies now unraveled. Last night, truth prevailed over secrecy. The tapes will speak for themselves. Strap in for August.”
President of the Oversight Project, Mike Howell:
“This is a tremendous win for the American people and I’m glad the Oversight Project could deliver it. From discovering the autopen scandal, which President Trump has correctly called the scandal of the century, to doggedly pursuing every last angle, the Oversight Project has not rested for years. Our work has resulted in dangerous criminals with phony autopen prison commutations put back in jail, a national understanding of how broken the Biden Administration was, and now will further develop the timeline of Biden’s deterioration with the release of these tapes. The evidence is stacking up that the sin was corporate in that the Democrat establishment, media, and power brokers knew that Biden wasn’t capable of being president but they pushed him anyways in favor of an unconstitutional governing strategy of rule by commission via a mechanical autopen device. People will always remember the disastrous Biden years, but thanks to us, they will also know more about how and why they happened.
I’m tremendously proud of our team that fought for years and ultimately beat Joe Biden’s fancy and expensive lawyers in D.C. court not once but twice. This is the power of a mission-aligned and patriotic group that fights for what is right and to deliver wins to the American people. We are thankful for the partnership of Dr. Kevin Roberts and the Heritage Foundation who incubated our work and stood by us throughout this long litigation.”
